Preamble
The Echadi Nation Republic (ENR), as a sovereign Indigenous government, acknowledges its inherent responsibility to protect the natural, cultural, and human rights of its nationals and communities. This Act affirms the ENR’s commitment to upholding universal principles derived from natural law, the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP), the International Covenant on Civil and Political Rights (ICCPR), and other relevant international frameworks. It ensures that ENR governance aligns with global human rights standards, including but not limited to the Universal Declaration of Human Rights (UDHR), the International Covenant on Economic, Social, and Cultural Rights (ICESCR), and the American Declaration on the Rights of Indigenous Peoples (ADRIP).
Section 1: Preservation of Natural Rights
The Echadi Nation Republic hereby enshrines the inherent and inalienable rights of individuals, Indigenous peoples, and communities within its jurisdiction, ensuring their full enjoyment of natural, human, and cultural rights.
Section 2: Alignment with International Frameworks
This Act adopts and implements the principles of UNDRIP, ICCPR, ICESCR, and other international human rights conventions as a foundation for ENR policies and legal interpretations.
Section 3: Commitment to Justice and Sovereignty
The Echadi Nation Republic is committed to protecting the dignity, sovereignty, and well-being of its nationals, with an emphasis on cultural preservation, self-governance, and autonomy.
Section 1: Fundamental Rights
1. The right to life, liberty, and security shall be protected in accordance with ICCPR Article 6 and UDHR Article 3, recognizing every individual’s inherent right to personal freedom and safety.
2. All nationals and Indigenous peoples within the ENR jurisdiction shall be entitled to equality before the law and protection against any form of discrimination based on race, ethnicity, gender, religion, or cultural identity, in accordance with ICCPR Article 26, UDHR Article 7, and UNDRIP Article 2.
3. Indigenous peoples and individuals shall have the right to self-determination, including the right to freely determine their political status and pursue their economic, social, and cultural development, as recognized in ICCPR Article 1, UNDRIP Article 3, and ADRIP Article 3.
4. The right to freedom of thought, conscience, and religion, including the practice and expression of Indigenous spiritual traditions, shall be upheld in accordance with ICCPR Article 18, UDHR Article 18, and UNDRIP Article 12.
5. Indigenous peoples shall have the right to participate in decision-making processes affecting their rights, lands, and cultural heritage, as provided under UNDRIP Articles 18 and 19 and ADRIP Article 21.
Section 2: Cultural Rights
1. The Echadi Nation Republic recognizes the right of Indigenous peoples to protect and develop their cultural heritage, traditional knowledge, and expressions of identity, as established in UNDRIP Article 11 and UDHR Article 27.
2. Indigenous peoples shall retain the right to own, manage, and control their ancestral lands and resources, as articulated in UNDRIP Article 26 and ADRIP Articles 25 and 26.
3. Sacred sites and ceremonial grounds shall be protected under ENR law, ensuring respect for Indigenous spiritual practices, in accordance with UNDRIP Article 12 and ICCPR Article 18.
4. Indigenous education rights shall be upheld by guaranteeing access to learning systems that respect Indigenous languages, histories, and cultural practices, in accordance with UNDRIP Article 14 and ICESCR Article 13.
Section 1: Legislative and Judicial Oversight
1. ENR laws and policies shall integrate principles from UNDRIP, ICCPR, ICESCR, and ADRIP to reflect international best practices for human rights protection.
2. The ENR Jural Society shall oversee the enforcement of this Act, ensuring that all laws and rulings align with the ENR Constitution and the principles of natural rights.
Section 2: Oversight Bodies and Committees
1. A Natural Rights Oversight Committee shall be established as an independent body responsible for monitoring compliance with this Act, investigating violations, and recommending appropriate remedies. The committee shall consist of representatives from the Jural Society, cultural leaders, and human rights experts.
2. Nationals shall have the right to file grievances concerning violations of this Act with the ENR Jural Society or the Natural Rights Oversight Committee.
1. The ENR Ministry of Education shall implement curricula that educate nationals about their natural rights and international human rights frameworks, including UNDRIP and ICCPR.
2. The Ministry of Cosmology shall develop and implement programs for cultural preservation, language revitalization, and the intergenerational transmission of traditional knowledge.
3. The Echadi Nation Republic shall actively advocate for Indigenous and Aboriginal rights at regional and global forums, ensuring alignment with international human rights organizations.
1. Any act of violence, discrimination, or suppression of cultural practices is strictly prohibited. Violators shall be subject to penalties as determined by the ENR Jural Society.
2. The unauthorized exploitation of Indigenous lands, resources, or sacred sites is prohibited and shall result in restitution and legal penalties.
3. Any attempt to suppress the political self-determination or cultural expression of Indigenous peoples within ENR jurisdiction shall be considered a violation of this Act.
1. This Act shall undergo a comprehensive review every five years to assess its effectiveness and ensure alignment with evolving international human rights standards.
2. Indigenous and Aboriginal communities shall be actively involved in shaping the policies and practices under this Act through participatory governance structures.
3. The Echadi Nation Republic shall allocate resources to strengthen institutional capacity for the enforcement and awareness of this Act.
This Act shall be interpreted and enforced in alignment with the following international human rights instruments:
• United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) – Affirming Indigenous rights to self-determination, cultural preservation, and autonomy.
• International Covenant on Civil and Political Rights (ICCPR) – Recognizing the right to life, freedom of thought, and equal protection under the law.
• International Covenant on Economic, Social, and Cultural Rights (ICESCR) – Promoting the rights to education, cultural participation, and self-development.
• Universal Declaration of Human Rights (UDHR) – Establishing universal principles of human dignity, freedom, and equality.
• American Declaration on the Rights of Indigenous Peoples (ADRIP) – Supporting the collective and individual rights of Indigenous peoples in the Americas.
Enactment and Authorization
This Act is enacted by the Parliament of the Echadi Nation Republic on November 9, 2024, under Bill No: ENR-2024-002.
